Felony Offense of Trespassing

Our client was charged with the felony offense of trespassing while armed with a firearm. We filed a Motion to Dismiss the charges under Rule 3.190(c)(4) arguing that the crime of trespassing had not occurred under the trespassing statute’s strict notice requirements. The prosecutor–who was originally seeking a guilty plea to a felony charge and repayment of thousands of dollars in restitution–agreed to dismiss the charges as part of a deferred prosecution agreement with no admission of guilt and no  payment of restitution.  

Misdemeanor Time Served Sexual Battery,
3 of 4 counts Dropped 

Our client was charged with 4 counts of sexual battery. After fighting his case for over a year, we worked out a resolution that avoided the risk of a jury trial: time served (no jail) to one reduced count of misdemeanor battery. The remaining 3 counts were dropped.

Our client was charged with three charges of grand theft. Our law firm prepared a very detailed package to the prosecutor in order to show that our client was not guilty of the allegations. The State declined to file charges against our client after we submitted that information for the prosecutor's review.

If she had had a lawyer, she would not have been convicted. Our motion was granted and her conviction was vacated by the court. The prosecutor dropped the charges.

Motion to Dismiss was granted by the court because the statute of limitations had passed. My client was charged with Driving Under the Influence several years ago without an arrest, and the case languished in the court system with no action and without his knowledge. This violated his rights to challenge the evidence in a timely fashion.

My client had received bad advice from a prior lawyer during his trial to turn down a favorable plea bargain. After his trial, he was sentenced to 15 years in prison. I filed a motion to vacate his conviction and sentence. The prosecuting lawyer agreed with my motion. The court vacated my client's sentence and allowed him to take a time-served plea. He was released from jail on the charge the same day.

My client had received bad advice from his prior lawyer who failed to tell him that pleading guilty to felony marijuana possession would cause him to be deportable from the United States. I filed a motion asking the judge to vacate his conviction. After reviewing my motion, the prosecuting lawyer agreed. My client's conviction was vacated and he was allowed to resolve his case in a way that permitted him to protect his green card.
